The Alabama framework: Alabama Code § 30-2-5 requires one spouse to have lived in Alabama for six months. Nothing in the statute requires either spouse to appear in court for an uncontested case, and Alabama’s circuit courts accept electronically filed pleadings statewide. Out-of-state notarizations are valid on the documents.
The biggest mistake: Confusing an online divorce from a law firm with a “divorce kit” from a website. The kit gives you forms and leaves you to file them. What an Online Divorce With Our Firm Looks Like
Here is the honest version of what happens. You call for a free phone consultation. An attorney confirms you qualify and quotes your total. You retain us by card or online payment. We email a short questionnaire, draft the Complaint, the Marital Settlement Agreement, the Answer and Waiver, and any child support forms, and email the package to both spouses.
You each sign before a notary. A bank, a UPS Store, a courthouse, or a mobile notary all work, in Alabama or anywhere else. You mail the originals back or drop them at an office if one is convenient. We file electronically with the Circuit Clerk in your county. Thirty days later, or a little longer depending on the judge’s docket, the decree is signed and we mail certified copies. People are right to ask how a divorce can be legal without anyone appearing before a judge. The short answer is that Alabama law never required an appearance in an agreed case: the plaintiff’s testimony is submitted as a sworn written statement, the other spouse waives formal service in writing, and the court accepts the filing electronically. Why You Do Not Go to Court
In an uncontested divorce, there is nothing for a judge to decide. Both spouses have already agreed to every term in a signed settlement agreement, and the plaintiff’s sworn testimony is submitted in writing. The judge reviews the file, confirms the agreement meets Alabama’s requirements, and signs the decree. No testimony is taken in a courtroom because none is needed.
A few judges in a few counties do set brief hearings in cases with minor children, most often in Madison County, and we tell you up front if your county is one of them. Online Divorce From a Law Firm Versus an Online Form Site
The phrase “online divorce” is used by two very different products. The form sites generate documents from a questionnaire and hand them to you. You file them yourself, you fix them yourself when the clerk sends them back, and nobody has read your agreement with a lawyer’s eye. The price looks lower until you count a rejected filing, a re-executed set of signatures, and the clause that gave away the retirement account.
