Baldwin County

Baldwin County requires the class to be taken locally and in person, unless the court grants a motion to permit an online alternative — typically only granted for significant distance, out-of-state residence, or hardship.

The division is determined by the parties’ residence within the county.

Different filing sequence. Jefferson County uses a different procedural sequence than other Alabama counties. The divorce Complaint is filed first, and the supporting documents (Answer and Waiver, Settlement Agreement, sworn Testimony of Plaintiff) are then executed by the parties and filed afterward in the pending case. In all other Alabama counties, every document is signed before filing and submitted together. We handle this two-step Jefferson County filing process for our clients.

If the assigned judge orders the class, it must be completed locally. We do not always know in advance whether the class will be required, but we walk clients through it if so.

How much does it cost to file for divorce in Alabama?

Court filing fees for divorce in Alabama vary by county and currently range from approximately $200 to $340. Each fee shown on this page includes the electronic filing convenience fee charged by Alabama courts — typically $10 to $15 above the base statutory fee — since virtually all Alabama uncontested divorces are now filed electronically. Filing fees are separate from attorney fees. The Harris Firm advances the filing fee at the time of filing, and clients reimburse the firm for the filing fee before the case is submitted to the court.

Why do divorce filing fees vary by Alabama county?

Each Alabama circuit court sets its own divorce filing fee. The total fee includes a base statutory amount, county-specific court surcharges, and the electronic filing convenience fee charged by the Alabama Administrative Office of Courts. Counties with higher local surcharges have higher filing fees. The Alabama Legislature and the AOC periodically adjust the base fee and the convenience fee, so the amounts shown on this page are reviewed annually and updated throughout the year as we file in individual counties.

Do all Alabama counties require a parenting class for divorce?

No. Approximately seven to ten Alabama counties currently require parents in cases with minor children to complete a parenting class before the divorce can be finalized. Several other counties leave the requirement to the discretion of the assigned judge, meaning the class is required in some cases and not in others within the same county. The remaining counties do not require a parenting class. Whether your county requires a parenting class depends on the specific county and, in some counties, on the assigned judge. Can I file my Alabama divorce in any county?

An uncontested divorce in Alabama is filed in the circuit court of the county where either spouse currently resides. At least one spouse must have lived in Alabama for at least six months before filing.
