Filing a Low Cost and Fast Divorce in Alabama

Simple Uncontested Divorces for $320

Filing an uncontested divorce in the State of Alabama can be the easiest way to obtain an inexpensive and fast divorce.  It requires that you and your spouse reach an agreement pertaining to your marital assets, custody, child support, and all other marital issues prior to filing for divorce.  Low Cost DivorceThe Agreement is then filed with the initiation of the uncontested divorce proceeding, and since an agreement has been reached and there are no contested issues in the case, you can usually receive your divorce decree quickly and without having to go to Court.  

By reaching a divorce agreement with your spouse you can receive a relatively inexpensive and fast divorce in most cases (compared with the costs of a contested divorce).  Our divorce lawyers currently charge a flat fee of $320 for simple uncontested divorces without minor children of the marriage and $420 for simple uncontested divorces with minor children of the marriage.  It is a simple uncontested divorce if you have already reached an agreement, we receive everything all at once prior to filing the Complaint so that all of the documents can be filed at the time of the Complaint, or if there are no additional or unusual documents to be prepared such as a Qualified Domestic Relations Order (QDRO) or a Quit Claim Deed, or if there is no Court date set in the proceeding.  

If a Complaint is to be filed separately or if an agreement has not been reached yet and further negotiations are necessary then you will not qualify for this low cost reduced fee since it is not an uncontested divorce.  Our cheap divorce lawyers can work some kind of flat fee arrangement out with you depending on the complexity of your situation and it will usually not be too much more expensive than the simple uncontested divorce attorney fee.

Low Cost Divorce Process

To get the low cost divorce process started, you would need to call our office and speak to our paralegal Amy and request that we send you an uncontested divorce questionnaire for you to fill out and return to us.  Once we have received the questionnaire, one of our uncontested divorce attorneys can call or meet with you to go over the information, counsel you, and answer any questions you may have about the legal matter.  Once the documents are prepared, we will get these documents to you for you to properly sign, execute, and return to our office for us to file your fast and easy divorce with the Courts.  

Therefore, as long as you and your spouse have reached an agreement, there are no hearings necessary in your case, and you do not require a QDRO or deed, then the flat fee rate for a simple uncontested divorce should apply in your case.  In order to file your low cost divorce, there is a filing fee that varies from county to county and this fee must be paid to the Court when your uncontested divorce is filed.  For example, the filing fee in Jefferson County is about $207 while the filing fee in Madison County is about $337. 

You will still have to pay the filing fee before we can file your divorce for you, but this goes to the particular County Court you are filing in and is not considered part of the attorney fees.  We do not charge extra if you wish to resume the use of your maiden name in the divorce.  If you would like to return to your maiden name, then we can put this in the divorce decree and it can be ordered at no additional cost to you.  However, if you fail to inform our lawyers of this request and it is not included in the Divorce Decree, then the proper way, at that point, to restore your maiden name would most likely be through the local Probate Court.
