SOCIAL SECURITY DISABILITY

      In order to obtain Social Security Disability benefits, you must be disabled under the Social Security rules.  In order to be found disabled you must: 1) not be able to do the work that you did before becoming disabled; 2) not be able to adjust to other work because of your medical condition; and 3) your disability must have lasted or be expected to last for at least one year or to result in death.  Some special situations include disabled widowers or widows, disabled children, and people who are blind or have low vision. 

The first step in determining whether an individual is disabled is whether they are not working and their earnings average less than $1,000 a month.  If they are not working, then the next step is to determine whether the condition is “severe”.  If the condition is “severe”, then it must be found in the list of disabling conditions.  If the condition meets one of these listings, then an individual is found to be disabled.  If a listing is not met, then in order to be found disabled you cannot be able to do the work that you did previously and not be able to adjust to other work. 

If you have applied for disability benefits and been denied, you only have sixty days to appeal this decision.  Therefore, you must act quickly in order to preserve your rights to appeal the initial denial and request a hearing before an Administrative Law Judge.
